Terms of sale

1. Parties and acceptance

These terms govern the purchase of Cymatica's paid plans between Braian Axel Barros Miranda (NIF 26901445R, Gran Via de les Corts Catalanes 769, piso 3, 08013 Barcelona, contact@cymatica.es) and the user. They are accepted by ticking the corresponding box in the Stripe checkout. The language of the contract is Spanish. The contract is filed electronically and a copy can be requested at contact@cymatica.es.

2. The Service

Cymatica is a web application for viewing cymatics in real time, with a free version and paid features, and a software device for Ableton Live ("Cymatica for Ableton"). The features of each plan are described on the pricing page at the time of purchase and form part of these terms.

3. Plans and prices

Prices include the VAT applicable to consumers in the European Union, calculated by Stripe Tax according to the buyer's country. For businesses with a valid EU VAT number, the reverse charge applies where relevant. Braian Axel Barros Miranda may change the prices of subscription plans with at least 30 days' notice by email; the new price applies at the next renewal and the user can cancel before then at no cost.

4. Payment

Payments are processed through Stripe. Braian Axel Barros Miranda does not store card data. The invoice is sent by email and is available in the customer portal. If a renewal charge fails, Stripe retries it during a grace period in which Pro access is kept; if it is not resolved, the subscription is cancelled and the account returns to the Free plan.

5. Renewal and cancellation

Subscriptions renew automatically at the end of each period for the same term, unless cancelled. You can cancel at any time from Account → Manage subscription (Stripe portal). Cancellation takes effect at the end of the period already paid for: you keep Pro access until that date and no further charges are made. The unused part of the period is not prorated or refunded, except as provided in the guarantee.

6. 14 day guarantee

For any paid plan, if within 14 calendar days of the first payment you decide that Cymatica is not what you expected, you can request a full refund by writing to contact@cymatica.es. It is refunded through the same payment method within a maximum of 14 days from the request. This guarantee is voluntary, is offered once per user and does not limit the consumer's statutory rights. A refund of Founders releases the seat; a refund of Cymatica for Ableton revokes the licence and requires the downloaded copies to be deleted.

7. Right of withdrawal

As a consumer, you have the right to withdraw from the contract within 14 calendar days without giving a reason. In the case of digital content not supplied on a tangible medium (Pro access and the device download), Article 103.m of the Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios (TRLGDCU, the Spanish consolidated Consumer Protection Act) provides that the right of withdrawal is lost once performance has begun with your express consent and your acknowledgement that you thereby lose that right. By completing the payment you agree that access begins immediately. In any event, the 14 day guarantee in clause 6 lets you obtain a full refund within that same period, so in practice your rights are not reduced.

Withdrawal form: send an email to contact@cymatica.es with the subject "Desistimiento", the email address of your account and the date of purchase.

8. Founders and "lifetime"

The Founders plan gives access to every Pro feature and to Cymatica for Ableton through a one off payment, with no further fees. "Lifetime" means for as long as Cymatica exists as an online service, with no fees and no price increases. Should Braian Axel Barros Miranda decide to discontinue the Service, this will be announced with at least 90 days' notice and an offline version of the web application and of the device will be offered for download, with the features available at that time, with no right to an additional refund once 12 months have passed since the purchase.

Founders is limited to 50 seats and to 60 days from the published launch date. If a technical error allowed more than 50 purchases, those beyond the quota will be refunded in full and notified by email. A user with an active Pro subscription who buys Founders will have that subscription cancelled at the end of the current period, with no further charges.

9. Licence for Cymatica for Ableton

When you acquire Cymatica for Ableton (as a standalone purchase or included in Pro yearly or Founders) you receive a personal, non exclusive and non transferable licence to install and use the device on the computers you own. The right to download is permanent from the first download, even if you later cancel the Pro subscription. It is limited to 10 downloads per day.

Generated content. The videos, images and captures you produce with Cymatica (web or device) are yours and you can use them for personal and commercial purposes (social media, live shows, client work, music videos) with no attribution required. In the free version of the web app they carry the "CYMATICA" watermark.

Not permitted. Redistributing, reselling, sharing or publishing the .amxd file, decompiling it or extracting its code and shader, or circumventing its technical limits.

Requirements. Ableton Live 12 Suite with Max 9 and the glcore graphics engine. Check the requirements before buying: the 14 day guarantee covers cases where it does not run on your machine.

10. Free version and limits

The free version has limits on scope (presets, layers, resolution, watermark, duration and number of daily sessions) that reset every day at 00:00 UTC. The limits are enforced through counters on the server and in a signed technical cookie. Attempting to circumvent them by technical means is a breach of these terms and may lead to suspension of the account.

11. Account and acceptable use

You are responsible for the security of your account. You may not share it, use the Service for unlawful purposes, deliberately overload it or use the visuals to induce photosensitive reactions in others. Braian Axel Barros Miranda may suspend accounts that breach these terms, with prior notice except in urgent cases.

12. Availability and changes to the Service

Braian Axel Barros Miranda undertakes to exercise reasonable diligence in keeping the Service available, without guaranteeing the absence of interruptions. Features may be added, changed or withdrawn; if an essential feature of a paid plan is withdrawn, this will be announced 30 days in advance and the user may cancel with a proportional refund of the unused period.

13. Notices

• Naturaleza del Servicio: see the notice in clause 6 of the Legal notice, which forms part of these terms. Cymatica is a tool for visualising sound and for practice with intention. It is not a medical device.
• Fotosensibilidad: the Service shows moving patterns and changes in contrast. If you are photosensitive, turn on "Reduce motion" in your system or do not use it. Binaural mode never syncs the visuals with the audible beat.
• Volumen: pure tones can be unpleasant at high volume. Start at the minimum.

14. Liability

To the extent permitted by law, the liability of Braian Axel Barros Miranda towards the user is limited to the amount paid in the 12 months before the event giving rise to it. Nothing in these terms limits the consumer's mandatory statutory rights.

15. Governing law and complaints

These terms are governed by Spanish law. For consumers, the courts of their place of residence have jurisdiction. You can use the EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr) or the Juntas Arbitrales de Consumo (the Spanish consumer arbitration boards).
